1. Acceptance of Terms

By accessing and using this website (byahamed.com), you accept and agree to be bound by the terms and provision of this agreement. Additionally, when using this site's services, you shall be subject to any posted guidelines or rules applicable to such services.

2. Description of Services

ByAhamed ("we", "us", or "our") provides freelance web design and development services including but not limited to:

  • Custom website design and development
  • Next.js and React based implementations
  • UI/UX design services
  • Performance optimization
  • Website maintenance and support

3. User Obligations

As a user of our services, you agree to:

  • Provide accurate and complete information when placing orders or contacting us
  • Maintain the security of any account credentials
  • Not use our services for any unlawful purpose
  • Not attempt to gain unauthorized access to any part of our website
  • Not interfere with the proper operation of our services

4. Intellectual Property

All content, designs, and materials created by ByAhamed remain our intellectual property until full payment is received. Upon full payment, ownership of the delivered website transfers to the client, except for:

  • Pre-existing third-party libraries and frameworks
  • Stock assets and fonts used under license
  • Reusable code components developed for general use

5. Payment Terms

Payment terms vary by project scope and are agreed upon before project commencement. For standard packages:

  • 50% upfront payment required to begin work
  • 50% balance due upon project completion
  • Payment must be made within 7 days of invoice date
  • All prices are in INR (Indian Rupees)

6. Project Timelines

Project timelines are estimates based on the agreed scope. Timelines may be extended if:

  • Client feedback is delayed beyond 48 hours
  • Additional requirements are requested mid-project
  • Content and assets are not provided in a timely manner

7. Limitation of Liability

ByAhamed shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use of our services. Our total liability shall not exceed the total amount paid by the client for the specific service in question.

8. Termination

Either party may terminate this agreement with 14 days written notice. Upon termination:

  • Client must pay for work completed up to the termination date
  • All deliverables up to termination date will be provided
  • No refund for work already completed and delivered

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Kerala, India. Any disputes arising under these terms shall be subject to the jurisdiction of Kerala courts.
